1. Introduction & Scope
This Privacy Policy explains how Send The Mess, a Washington sole proprietorship owned and operated by Brittany Chipman (“Send The Mess,” “we,” “us,” or “our”), collects, uses, discloses, and protects information in connection with sendthemess.com (the “Site”) and our Shopify catalog organization and launch services (the “Services”). It applies to visitors to the Site, prospective clients who submit our intake form, and Clients we serve, and — because our Services involve accessing your Shopify store — it also addresses information we may incidentally encounter belonging to your own customers.
This Policy is not a substitute for legal advice on your own obligations to your customers under applicable privacy law; it describes only how Send The Mess itself handles information.
2. Information We Collect
Information you provide directly. When you submit our intake form, contact us, or engage our Services, we collect information such as your name, business name, email address, and details about your Shopify store and catalog needs that you choose to share, including product content, images, and brand materials you upload or send to us.
Information collected automatically. Like most websites, our Site may use standard analytics and functionality provided by our hosting and page-building tools (including Shopify’s built-in analytics) to understand traffic and usage, which can include IP address, browser type, device information, and pages visited.
Information accessed through your Shopify store. Where an engagement requires store access, we may encounter data stored in your Shopify admin, including your product catalog, collections, store settings, and — incidentally — order and customer records that exist in your store. See Section 5 for how we handle this category specifically.
Payment information. Payment is processed by a third-party payment processor. Send The Mess does not directly collect or store full payment card numbers; the processor’s own privacy policy governs its handling of that data.
3. How We Use Your Information
We use the information described above to:
- Evaluate intake submissions and scope engagements;
- Deliver, manage, and communicate with you about the Services;
- Process payments and maintain business records for accounting and tax purposes;
- Improve our Site, service offerings, and internal processes; and
- Send you service-related communications, and, only with your consent, marketing communications, which you may opt out of at any time.
4. How We Share Your Information
We do not sell your information. We may share information with:
- Service providers who help us operate our business, such as our intake form provider (Tally), payment processor, email and productivity tools (such as Google Workspace), and hosting or deployment providers (such as Netlify) used to build engagement deliverables — each of whom is only given the access needed to perform their function;
- Professional advisors such as our accountant, where necessary for business operations; and
- Legal authorities, where required by law, subpoena, or to protect the rights, property, or safety of Send The Mess or others.
Any third party we share information with is expected to protect it consistently with this Policy and to use it only for the purpose we’ve engaged them for.
5. Data From Your Store & Your Customers
Because certain Services require access to your Shopify admin, we may incidentally have visibility into your own customers’ personal data (such as names, addresses, or order history) that already exists in your store. With respect to this data, we commit to the following:
- We access only what is reasonably necessary to complete the agreed scope of work;
- We do not export, copy, retain, sell, or independently use your customers’ personal data for any purpose of our own, including marketing;
- We do not make changes to customer records, orders, or store settings outside the agreed scope of work; and
- Our access is removed at the end of the engagement, as described in our Terms of Service and Client Service Agreement.
You remain the “data controller” (or equivalent) responsible for your own customers’ data and your own compliance with privacy laws that apply to your business (such as GDPR, CCPA, or others depending on where your customers are located); Send The Mess acts only as a limited-purpose service provider with respect to that data.
6. Data Retention
We retain intake submissions, engagement records, and communications for as long as reasonably necessary to deliver Services, maintain business and tax records, and resolve any disputes, after which we delete or anonymize it, except where longer retention is required by law. We do not retain your store’s backend data (including customer records) beyond the active engagement, as described in Section 5.
7. Data Security
We take reasonable administrative and technical measures to protect information in our care, including limiting access to information on a need-to-know basis and using reputable third-party providers for storage and communication. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights & Choices
You may ask us to access, correct, or delete personal information we hold about you by contacting us at sendusthemess@gmail.com, and we will respond within a reasonable time. You may opt out of marketing communications at any time using the unsubscribe link provided or by contacting us directly. Depending on your location, you may have additional rights under applicable law; we will honor valid requests to the extent required.
9. Cookies & Tracking Technologies
Our Site may use cookies or similar technologies provided by our hosting platform (Shopify) for basic functionality and analytics. You can control cookies through your browser settings, though disabling them may affect Site functionality.
10. Children’s Privacy
Our Site and Services are directed at business owners and are not intended for individuals under 18. We do not knowingly collect personal information from children.
11. International Visitors
Send The Mess is based in the United States, and information we collect is processed and stored in the United States. If you are visiting or engaging our Services from outside the U.S., you understand that your information will be transferred to and processed in the U.S., which may have different data protection laws than your home jurisdiction.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by an updated “Last Updated” date, and, where appropriate, communicated to active Clients. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Policy.
